AetherSignalWorks ("we," "our," "us") is committed to protecting the privacy and personal data of all visitors to our website and users of our services. 4. Data Retention

Refund Policy

1. Scope
This Refund Policy applies to all digital services provided by AetherSignalWorks, including web development, design, SEO, infrastructure deployment, copywriting, project management, and security hardening services.
2. Milestone-Based Delivery
AetherSignalWorks operates on a milestone-based project delivery model. Each project is divided into clearly defined phases with specific deliverables. Payments are structured to correspond with completed milestones as agreed in the service contract.
3. Refund Eligibility
(a) Pre-project deposits: Refundable in full if the project has not commenced and the cancellation request is made within 14 calendar days of payment, in accordance with EU consumer protection directives for distance contracts.
(b) In-progress projects: If a project is cancelled mid-execution, payment is retained for all completed milestones. Any advance payment for uninitiated milestones will be refunded within 30 calendar days of the cancellation request.
(c) Completed projects: No refund is available for fully delivered and accepted project milestones. Deliverables are considered accepted upon client sign-off or 7 calendar days after delivery without written objection.
4. Defective Delivery
If deliverables fail to meet the specifications agreed upon in the service contract, AetherSignalWorks will, at its sole discretion:
(a) Remediate the defect within a reasonable timeframe at no additional cost.
(b) Provide a partial refund proportional to the undelivered or defective portion of the work.
5. Refund Process
To request a refund, contact us at [email protected] with your project reference, a description of the grounds for refund, and any supporting documentation. Refund requests are processed within 14 business days of receipt. Refunds are issued via the original payment method.
6. Exceptions
Refunds will not be issued for:
(a) Work completed and accepted according to the agreed project milestones.
(b) Third-party costs incurred on behalf of the client (domain registrations, hosting fees, licensed software) that are non-refundable by the provider.
(c) Change-of-mind cancellations after the 14-day cooling-off period has expired.

1. Acceptance of Terms
By accessing the AetherSignalWorks website, requesting a consultation, or engaging our services, you ("Client") agree to be bound by these Terms of Service. If you do not agree, you must refrain from using our services.
2. Scope of Services
AetherSignalWorks provides professional web development, design, SEO, infrastructure, copywriting, project management, and security services. The specific scope, deliverables, timelines, and pricing for each engagement are defined in a written service agreement or project proposal accepted by both parties.
3. Client Obligations
The Client agrees to:
(a) Provide accurate, complete, and timely information necessary for the execution of the project.
(b) Designate an authorized point of contact for all project-related communications.
(c) Review and approve deliverables within the timeframes specified in the service agreement.
(d) Make payments according to the agreed schedule.
4. Intellectual Property
(a) Upon full payment, all intellectual property rights in the final deliverables are assigned to the Client. This includes source code, design assets, copywriting content, and technical documentation.
(b) AetherSignalWorks retains the right to use anonymized case studies, screenshots, and project descriptions for portfolio and marketing purposes, unless the Client objects in writing.
(c) Third-party libraries, frameworks, and tools used in the project remain subject to their respective open-source or commercial licenses.
5. Payment Terms
(a) Payment schedules are defined in the service agreement. Invoices are payable within 14 calendar days of issuance unless otherwise agreed.
(b) Late payments may incur a statutory interest rate of 4% per annum above the ECB reference rate, in accordance with Directive 2011/7/EU on late payment in commercial transactions.
(c) AetherSignalWorks reserves the suspend work on any project where payment is more than 14 days overdue.
6. Confidentiality
Both parties agree to maintain the confidentiality of all proprietary information exchanged during the course of the engagement. This obligation survives termination of the service agreement for a period of 24 months.
7. Limitation of Liability
To the maximum extent permitted by applicable law, AetherSignalWorks shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from the use of our services. Our total aggregate liability shall not exceed the total fees paid by the Client for the specific project giving rise to the claim.
8. Warranty
AetherSignalWorks warrants that all deliverables will conform to the specifications defined in the service agreement for a period of 30 calendar days following delivery. This warranty does not cover defects caused by modifications made by the Client or third parties after handover.
9. Termination
(a) Either party may terminate the service agreement with 14 calendar days' written notice.
(b) In the event of termination, the Client is obligated to pay for all work completed and accepted up to the date of termination.
(c) AetherSignalWorks may terminate the agreement immediately if the Client breaches material obligations, particularly payment terms, after receiving written notice and a 7-day cure period.
10. Governing Law and Jurisdiction
These Terms of Service are governed by the laws of Spain and the European Union. Any dispute arising from or in connection with these terms shall be submitted to the exclusive jurisdiction of the courts of Valencia, Spain.
11. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
12. Modifications
AetherSignalWorks reserves the right to modify these Terms of Service at any time. Material changes will be communicated via email to active clients or posted on this page with a revised "Last updated" date.
